The short version: HireLiving is a nonprofit that helps people find opportunity and helps businesses find the right people. We work hard for you, but we cannot guarantee a job, a hire, or a particular result. Please use the site honestly and respectfully, and read the sections below about fees, donations and how disputes are handled.
1. Agreement to these terms
These Terms and Conditions ("Terms") are an agreement between you and HireLiving, Inc. ("HireLiving," "we," "us," or "our"). They apply when you visit hireliving.org (the "Website") or use our services, forms, chat, texts, events or giving options.
By using the Website or our services, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website. You must be at least 18 years old, or have a parent or guardian's permission, to use our services.
If you sign a separate written agreement with us (for example, a recruiting agreement or a coaching agreement), that agreement controls wherever it conflicts with these Terms.
2. About HireLiving
HireLiving is a 501(c)(3) nonprofit organization in Gwinnett County, Georgia. We provide career coaching, job placement and recruiting support, employer partnerships, workforce transition support, and community programs, including Kids Motel Ministry. Faith-based programs are voluntary, and you are welcome to take part as you are comfortable.
Information on the Website is provided for general purposes. It is not legal, tax, financial, medical or employment advice, and you should consult a qualified professional about your own situation.
3. Job seekers
- Please give accurate, complete and current information, including your resume, work history and credentials. Do not submit false or misleading information.
- HireLiving connects job seekers with employer partners and coaching resources. We are not your employer, and we do not make hiring decisions.
- We cannot guarantee an interview, a job offer, a particular salary or start date, or that any position will remain open. Employers may run their own screenings, such as reference, background or drug checks.
- When you apply or ask for an introduction, you authorize us to share your information with the relevant employer or recruiting partner as described in our Privacy Policy.
- Job details come from employers and recruiting partners and may change or be filled without notice. Please confirm details directly with the employer.
4. Employers and business partners
- Please provide accurate job descriptions, pay and benefit information, and keep us informed when a position changes or is filled.
- You are responsible for your own hiring decisions and for complying with all employment laws, including equal opportunity, wage and hour, and anti-discrimination laws. Do not ask us to screen candidates on any basis that the law protects.
- We work to refer qualified candidates, but we do not guarantee that any candidate will accept an offer, perform in a particular way, or remain employed.
- Candidate information we share is confidential. Please use it only to evaluate and hire for the role discussed, and handle it with care.
- Placement fees, if any, are described in your written agreement with us.
5. Coaching, recruiting and fees
Some HireLiving services, such as individual career coaching, corporate outplacement or coaching, recruiting for client employers, and our online career kit, may carry a fee. Fees, payment schedules and any refund terms will be explained to you before you commit and, where applicable, set out in a written agreement or invoice.
Coaching and assessments are intended to support your growth. Results depend on many factors, including your own effort, and we cannot promise any specific outcome. Payments for services may be made through the payment options on our Donations and Payments page. Please use the correct payment category so your payment is applied properly; a service payment is not a charitable donation.
6. Donations and payments
- Tax status. HireLiving is a 501(c)(3) nonprofit, and gifts are tax deductible to the extent allowed by law. We will acknowledge your gift in writing. Please consult your tax advisor about your own deduction. If you receive goods or services in return for a gift, only the amount above their value may be deductible.
- Use of gifts. Gifts support our mission. If you designate a gift (for example, to Kids Motel Ministry or the scholarship mission), we will use it for that purpose. If that purpose is met or can no longer be carried out, we may use the gift for a similar purpose that serves our mission.
- Recurring gifts. If you choose a recurring gift, you authorize us and our payment providers to charge you at the interval you select until you cancel. To change or cancel, contact us using the details in section 18 before your next payment date.
- Refunds. Gifts are generally non-refundable. If you made a mistake, such as a wrong amount or a duplicate charge, contact us promptly and we will review it in good faith.
- Processing. Online payments are processed by third-party providers such as Stripe and PayPal under their own terms. Check donations may be mailed to the address on our Donations and Payments page.
- Other ways to give. Gifts of stock, real estate, in-kind goods or services, and sponsorships are accepted at our discretion and may require a separate agreement or review.
7. Using the website
You agree to use the Website lawfully and respectfully. You agree not to:
- break any law or the rights of others, or submit false, misleading or fraudulent information or payments;
- harass, threaten, defame or discriminate against others, or post unlawful, abusive or inappropriate content;
- attempt to gain unauthorized access to the Website, our systems, or other users' information;
- upload viruses or harmful code, or interfere with the Website's operation or security;
- use bots, scrapers or automated tools to collect data from the Website, or copy job listings or candidate information for resale or unrelated marketing;
- pretend to be another person or organization.
We may remove content or limit access if we believe these rules have been broken.
8. Your submissions
You keep ownership of anything you send us, such as a resume, message or feedback. By sending it, you give HireLiving permission to use it to provide and improve our services, and, for resumes and applications, to share it with employers as described in the Privacy Policy. We will not publish your name, photo, story or testimonial publicly without your permission.
9. Our content and trademarks
The Website, including its text, design, graphics, logos (including the HireLiving and Kids Motel Ministry names and logos), photos and layout, belongs to HireLiving or its licensors and is protected by copyright and trademark laws. You may view and print pages for your own personal or internal use. You may not copy, modify, distribute or use our content or marks for commercial purposes without our written permission.
Sponsor and partner logos on the Website belong to their respective owners and are shown with their permission.
10. Third-party links and listings
The Website links to websites and services we do not own, including employer and recruiter application pages, social media, and payment providers. We do not control them and are not responsible for their content, accuracy, terms or privacy practices. A link is not an endorsement. Job listings are provided by employers and recruiting partners, and we are not responsible for their accuracy or for any employment relationship that results.
11. Text messages
If you agree to receive texts from HireLiving, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not required to use our services or make a donation. See our Privacy Policy for details.
12. Disclaimers
The Website and our services are provided "as is" and "as available." To the fullest extent the law allows, HireLiving disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Website will always be available, error-free or secure, or that job listings, employer information or candidate information will be complete or current.
13. Limitation of liability
To the fullest extent permitted by law, HireLiving, its directors, officers, employees, volunteers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost wages, lost profits, lost opportunities or loss of data, arising from your use of the Website or our services, or from any employment decision, hiring decision or interaction between a job seeker and an employer. Our total liability for any claim relating to the Website or our services will not exceed the amount you paid us for the service at issue in the 12 months before the claim, or $100 if you paid nothing.
Some places do not allow certain limits, so parts of this section may not apply to you.
14. Indemnification
You agree to defend and hold harmless HireLiving and its directors, officers, employees, volunteers and partners from claims, losses and expenses, including reasonable attorneys' fees, that arise from your misuse of the Website, your violation of these Terms or of the law, or information you submit that is false or infringes someone else's rights.
15. Changes and termination
We may update these Terms from time to time. When we do, we will post the new version on this page. By continuing to use the Website after a change, you accept the updated Terms. We may suspend or end your access to the Website or our services at any time if you violate these Terms or if we need to protect HireLiving or others.
16. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. If a dispute arises, we ask that you contact us first so we can try to resolve it informally. If we cannot, you and HireLiving agree that the state and federal courts located in Gwinnett County, Georgia, are the proper place to resolve the dispute, and you consent to their jurisdiction.
17. General terms
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a part of these Terms is not a waiver of it. You may not transfer your rights under these Terms without our consent. These Terms, together with the Privacy Policy and any written agreement between us, are the entire agreement between you and HireLiving about the Website and our services.
